Terms of Use

By registering at Fortuno app you confirm that you have read and accept the Terms of Use and Privacy Policy to use the services described on the website (www.fortuno.app) and offered by the application (Android), agreeing to it without modification. If you do not agree with the terms of use described here, you will not be able to use them.

In order to improve the services provided, changes and corrections to the Terms of Use and Privacy Policy may be made for your update, regardless of prior notice, and you will be notified by a message in the application or by other means of communication.

We will keep the Terms of Use and Privacy Policy updated and with the latest version date always available and, by continuing to use the services after updating, you will be agreeing to the changes; if you do not agree, you must stop using and cancel the services, following the instructions in the item “Acquisition and Cancellation Form”.

Fortuno’s technical support is provided primarily via email (ajuda@fortuno.app) and also through the communication channels.

Fortuno Account

To access the services, you must create an account on the application on a smartphone with Android version 5.0 or higher and internet access, providing a valid e-mail address owned by you to validate the registration or using your Google or Facebook account.

Fortuno has two versions, the free (Basic plan) and the paid (Premium plan), described in detail on the website (www.fortuno.app).

Premium plan evaluation period

When you create a Fortuno account, you automatically receive 15 days of access to the Premium plan (paid service) for evaluation, without any automatic purchase of the Premium plan after that period. When the period expires, the features that are accessible exclusively with payment will be automatically disabled, without any inserted data loss in that period in the application.

Acquisition and cancellation form

The Premium plan is sold through recurring monthly or annual subscriptions and occasionally at our discretion, whether limited or not, in the form of a single license (with lifetime access and without recurrences). Subscription fees may vary according to seasonality.

Subscriptions are automatically renewed, unless you cancel them directly via Google Play in the “Subscriptions” menu under “Cancel subscription”. When you cancel a subscription, you will still be able to access the Premium plan content for the remainder time of the current billing period; after that period, the features accessible exclusively for payment will be automatically disabled.

If you already have an active monthly or annual Premium subscription and want to purchase the lifetime Premium plan, you will have to wait for the end of the subscription period to purchase it and must manually cancel your recurring monthly or annual plan. You can contact us through the email “ajuda@fortuno.app” if you need support in the process.

Refund policies

The amount paid will be fully refunded if requested within 7 (seven) days after the first charge is made, not valid for the next recurrences. After this period, Fortuno does not make a refund, so you can continue to use the application for the time purchased, during which the proper support will be provided. A partial chargeback or any refund will not be applied after this period. It is only possible to receive the refund once; if you buy this item again, you will not be able to receive another refund.

If a refund is made, you will lose access to features that belong exclusively to paid services. Refunds are returned in the same form of payment used for the original purchase. Depending on the form of payment, the time to receive a refund will be different, according to the Google Play Refund Schedule.

Our responsability

We are responsible for maintaining, for as long as possible, the services on the air, but there may be cases beyond our control that may cause a temporary unavailability of the website or application (“Random Cases or Force Majeure”). We will do our best to maintain the security and availability of the application and its data using appropriate backup practices and security policies. We are not responsible for damages caused to you by the use of our services, since we only provide a tool, and the content generated by it is inserted by you.

Our services do not guarantee specific results, guarantees of performance or other expectations. Fortuno does not guarantee that the information registered in the application will be available at all times, being certain that it can also be deleted, in specific situations, regardless of prior notice. As a result, it is the user’s sole responsibility to keep a copy of all information available in the application. In case of unavailability of access to the registered data, you can still access them on the device where you registered them if you keep the application installed.

Fortuno will not, under any circumstances, be responsible for any damages resulting from the interruption of access to the application, and/or to the information, regardless of the reason that causes this suspension, whether due to third party fault or not. Fortuno will make every effort to ensure that the reminder/scheduling system works perfectly, which does not replace the need for the user to have their own internal controls, and Fortuno cannot be held responsible in the event of any instability and/or malfunction of this function. To the maximum extent permitted by applicable law, the maximum amount for which Fortuno is responsible will not exceed the amount eventually paid by the user to purchase the application.

Your responsability

You, as a user of the services, are responsible for the security of your password. All content posted by you on the application is your responsibility, as well as all acts performed by you and any action taken based on the application’s data. It is up to you to keep a copy of all information available in the application.

Duration and finalization

Access to the application will be available indefinitely, and Fortuno may, at its sole discretion, at any time and regardless of reason or prior notice, suspend or discontinue, temporarily or permanently, users’ access to the application, without any indemnity or compensation to such users.

Final dispositions

Any existing disputes in relation to Fortuno’s Terms of Use and Privacy Policy regarding the use of the website and the application will be resolved in the District Court of São Paulo/SP, even if there is a more privileged one. We may not require you to comply with any provision, which will not represent a waiver of right or provision. Should any item of this be declared null or not applicable, the other terms will continue to apply and will remain in force and effect.
